any such Appointment or Suspension, and may make such Provision as under the Circumstances may seem fit respect- ing the Salary aperuing during such temporary Appointment or Suspension to the Officers affected thereby : (8.) The Power (so far as it shall not be other-

wise expressly provided by any Act of the Colonial Legislature) of suspending or removing from Office for Misbehaviour therein any Judge or other public Officer holding Office in the Colony during Life or good Behaviour; pro- vided that no such Suspension or Re- moval shall be valid unless made by the Governor, with the Advice and Con- sent of his Executive Council, on satis- factory Proof of the Matter charged, and after the Judge or other Officer charged shall have been allowed an adequate Opportunity of being heard before the Governor and Council in answer to the Charge, nor unless made by an Order under the Hand of the Governor and under the public Seal of the Colony; and provided also, that it shall be lawful for every Judge or Officer removed or suspended under this Section, at any Time within Twelve Calendar Months after the Date of the Order of Removal or Suspension, to appeal therefrom to Her Majesty in Council; but every such Removal or Suspension shall nevertheless take effect provisionally pending such Appeal, and until the same shall be decided, and the Result signified to the Governor :

(1. The Power, in the Name and on behalf of

Her Majesty, of granting to any of fender convicted of any Crime or Mis- demeanor in any Court of Justice, or before any Judge or Magistrate within the Colony, a Pardon, either free or subject

subject to such Conditions as may by Law be annexed to such Pardon, and also of respiting the Execution of the Sentence on any such Offender for such Period as to the Governor may seem

fit, and also of remitting the whole or any Part of the Punishment to which any such Offender may be sentenced, and also of substituting for any such Punishment if Capital, any other Punishment, which by the Law of the Colony might have been imposed for the same or any other less Offence, and also of remitting any Fines, Penal- ties, or Forfeitures whereof the Pro- ceeds may be payable to the Use of Her Majesty or of the Colonial Treasury:

(5.) The Power, subject to the Provisions herein-after contained, of assenting, in the Name and on behalf of Her Majesty, to any Bill passed by the Legislative Body or Bodies of the Colony, or of withholding his Assent therefrom, or of reserving any such Bill for the Signi- fication of the Royal Pleasure thereon: (6.) The Power, in the Name and on behalf of Her Majesty, and in the legal or ac- customed Manner, of convening, sum- moning for the Despatch of Business, proroguing, and so far as the Laws and Constitution of the Province may permit,

of dissolving the said Legislative Body or Bodies:

(7.) The Power, with the Advice of his Exe. cutive Council, and subject to the Laws of the Colony, of granting or disposing of all Lands in the Colony which may by Law be granted or disposed of by Her Majesty, either in conformity with his Instructions, or in conformity with such Regulations as may have been made by him in that Behalf, with the Advice of his Executive Council, and (0.52.)
