Cross-examined: I do mason work for Magden Ismail. Magden Ismail gave his important work for first accused. I am not angry with first accused for that. I have no idea that eleventh accused had anything. There was a litigation between brother-in-law of Ismail and eleventh accused. Ismail lost that case.

I live near Hirumbura junction. It is not the Karapitiya junction. I remember the 3rd of June last. My house and boutique were damaged on that day, a little later than 12.0 noon. A crowd of about 300 people came and broke into thy boutique and removed the things away. I saw only tenth accused in that crowd. recognized others who are not here. Meera Lebbe Marikar had gone to fishing that day. I heard that his house was broken into that day

I live at Hirumbura, about e quarter of a mile away from the mosque. remember the 3rd of June last. At about 9.0 or 10.0 in the night I heard a report of a gun.
I came out. At that time there were about 1,000 people at the mosque. I saw some directing the crowd to do something with their fingers. I saw eighth accused come with a lighted candle and burn something, and there occurred an explosion. Immediately after I heard another explosion from the back side of the mosque. After that I saw the roof going down. Then the crowd entered the opposite house. One James came and burnt that house. He is not here.
Cross-examined: I did not see any Moormen. I was in the adjoining land next to the mosque. At first I was not frightened, but when I saw the crowd I was frightened. I identified fourth, second, ninth, and eighth accused at the mosque. Meera Lebbe Marikar, affd.

I acted as interpreter before this court martial and before the Special Com- missioner. I live near the mosque at Labuduwa I was at home on the night of the 3rd June. Fourth accused came to my house that night. There were two men on the road when he came to my house. He asked us to close our doors, and went away. About two or three minutes afterwards I heard the smashing of the glasses of the mosque. The mosque is about twenty yards from my place. I was looking from my house. I heard explosions.
Then someone threw stones at our house. Then somebody from the side of the mosque said: "Wait a little.' Then I got afraid, thinking that they might put dynamite into my house also.
I, with my mother and sisters, went to the jungle behind our house." Eighth accused put the dynamite Tenth accused was there. There were about 900 or 1,000 people in the crowd They broke our house. One James set fire to our kitchen. He is not here. My father was assaulted. All the things in our house were removed. My Ceylon Light Infantry uniform was also removed. Only our kitchen was burnt. tenth accused carrying some clothes. It was about 12.0 or 1.0 p.m. I saw him in the night also with the crowd.
Cross-examined: One of our uncles had a case against eighth accused. uncle got one year's rigorous imprisonment.

You never assaulted my brother. I did not scold you. I am not angry with any Sinhalese people. You never had a tea boutique.
Mr. Erskine, sworn.
I am a member of the Ceylon Planters' Rifle Corps. I was on duty on the 3rd of June last. I went to Hirumbura on that day between 5.0 and 6.0 p.m.
I was there for about a quarter of an hour. We reached Karapitiya junction at about 4.30 p.m. I saw eleventh accused near Karapitiya junction, near a race cart.
We were in the car. At that time the boutiques had been attacked. Ibrahim pointed out eleventh accused to me and said that he was the ringleader. I asked him to stop. He did not stop. He drove away his race cart and went away. I saw a police officer. I cannot say who he is.
Cross-examined: It is a common thing that villagers run away as soon as they see military people. I did not see any Moormen there.

I am a gem dealer. I was at Hirumbura junction on the 3rd June. I went there with Mr. Erskine. I told Mr. Erskine that eleventh accused must be arrested. Cross-examined: I told Mr. Erskine that eleventh accused must be a leader. I know there was a Eleventh accused won
I told him that eleventh accused was an influential rowdy. litigation between Magden Ismail and eleventh accused. that. I am nephew of Magden Ismail.

I am police officer, Dedugoda. There are about 130 or 140 Moor houses in my village. There are three boutiques broken in my village, just at the extremes of the boundary. There are six Moor bungalows in my village; five of them are vacant, None of them are damaged. On the night of the 2nd I got information that there was disturbance at Galle bazaar. I asked the Moors in my division not to leave I told him what I heard their houses. I went to the police officer, Hirumbura. about Galle bazaar. On the 3rd I heard that martial law was proclaimed. about 5.0 p.m. that I heard it. I did not go to Karapitiya or Labuduwa along with a crowd.
I was not at the mosque. There is an ill-feeling between me and the Moors. On the 2nd April there died a child in that village. I informed the police I put it down in my diary (diary produced to that it was a suspicious death.

I am sure that they are false. turbances. I heard the evidence against me. came to Galle on the 3rd. My place is about three miles from fort, Galle. I came I came to the Mudal- to the fort about 7.0 or 8.0 a.m. in the morning of the 3rd June.
It was 7.30 or 8.0 when I iyar's. As he was not there I went to the Kachcheri. went to the Kachcheri. There was a meeting at the Kachcheri to take special The Superintendent of constables. I also wanted to join as a special constable.
The Superintendent gave a speech Police told me not to join, as I am a headman. to the special constables at the Green, and I was listening to it for some time. Then when I was there the Assistant Government Agent called me, and I got into his car and came with him to the Galle bazaar. I got down near the boutique of Ponniah. The Assistant Government Agent also got down. The Assistant Government Agent There was and the Superintendent, I, and some others went to the Galle bazaar.

Then I met the head disperse the crowd. I was in Galle bazaar till about 3.0 p.m. clerk of the Kachcheri, Galle. He gave Sarentuka in charge of me and asked me to take him to his place. I had to pass Sarantuka's place on my way home.
I stopped at about 5.30 I reached home. Then I came to my division, Maitipe.
I stopped there for a Hadjiar's place, fearing that his brother was assaulted.
I told them while. Then some gentlemen (Mr. Erskine was there) came in a car.
Then Mr. that there was a disturbance there. I wanted to get into the car. Erskine asked me not to get in, but to stop at that place. I stayed near Hadjiar's bungalow. After that I went home. It was about 7.30 or 8.0 p.m. when I reached home. I did not go out of my house that night. Karapitiya junction is about half a mile from my place. I can swear that I did not take part in any disturbance.

I am well known to the Assistant Government Agent. I did not meet the Mudaliyar that day. His bungalow is below the Assistant Government Agent's place. I did Somebody told me that the Mudaliyar not go to the walauwe of the Mudaliyar. was not at home. I did not come to see the Mudaliyar the next day. I came to Till I came to Galle I knew see him on the 4th. It was not an urgent matter. nothing about disturbances. bazaar in order to prevent the disturbances in Galle.
