Conditions of Service

Tenure and Discipline

1. The employment of officers in the Public Service in Hong Kong is under the Colonial Government; their emoluments are paid solely from Hong Kong funds; and they are subject to the local laws, regulations, and General Orders and to the Colonial Regulations. The local laws, regulations, etc.. may be consulted on application at the Colonial Office. A copy of the Colonial Regulations is supplied to each officer on his selection for appoint-

ment.

2. Officers (other than those transferred to Hong Kong from a pensionable appointment in the service of the Crown elsewhere) will hold their appointments in the first instance on probation for three years from the date of their first arrival in the Colony.

3. It will be within the power of the Governor, subject to the approval of the Secretary of State, to give notice of the determina- tion of the probationary appointment at any time during the period of probation, without assigning any reason, on giving the officer

a free passage back to England together with such leave as he may have earned in respect of his service.

4. During the period of probation the Governor will further have full power, subject to the confirmation of the Secretary of State, to cancel the appointment at any time if the officer has been guilty of misconduct, or if the Governor is satisfied that he is inefficient and that his inefficiency is due to his own negligence or default; and in that event the officer will not be entitled to a free passage back to England, or to any leave of absence or pay after the date of the letter by which the cancellation is notified to him. 5. If the officer is at any time during the period of probation pronounced physically unfit for further service, his appointment may be terminated on that ground at the end of such leave of absence as may be granted to him under the regulations.

6. If after three years from the date of first arrival in the Colony the officer's appointment is confirmed, but not otherwise, he ceases to be on probation and becomes eligible for pension or gratuity on retirement in accordance with the law and regulations.

7. The Colonial Regulations specify the approved procedure to be followed in the Colony when the Governor deems it necessary to suspend the holder of a permanent appointment with a view to his removal from the Service.

8. The holder of any office may be required to discharge any duties upon which the Governor may think it desirable to employ him, and it will be within the Governor's discretion to station him wherever his presence may be considered to be most useful.

He is also liable, while on leave of absence, to be employed in the United Kingdom without extra remuneration if the Governor or the Secretary of State should think it desirable in the interests of the public service.

Passage on Appointment

9. A free passage from the United Kingdom to Hong Kong will be allowed to an officer on first appointment on his entering into an agreement to refund the cost of the passage in the event of his failing to serve for three years for any other reason than bodily or mental infirmity.

Salary

10. Half salary begins on the date of embarkation in England

on first appointment, and full salary from the date of arrival in the Colony. For the purposes of local payment salaries fixed in sterling are converted into Hong Kong dollars at rates fixed by the Government. The rate, as from the 1st of January, 1932, has been fixed at the current rate of exchange, subject to a minimum rate of 1 shilling and a maximum rate of 2 shillings to the dollar.

Courses of Study

11. An officer may be required to attend a course of instruction following his selection for appointment or during his leave from Hong Kong. The fees for any course of instruction taken by an officer by direction of the Government will be paid from public funds. An allowance will be paid to an officer who is required to attend a course of instruction before proceeding to Hong Kong to take up his appointment.

12. Officers may be required to pass such examinations in a Chinese or other oriental language as the Governor may direct, and may be required to proceed to China or elsewhere for the pur- pose of language study. Officers on probation in the Cadet Service and Police are required to proceed to Canton for the study of Cantonese. Failure to pass the prescribed examinations may ad- versely affect un officer's position in the Service either as regards his salary, seniority, or confirmation in his appointment.

Quarters

13. Partially furnished quarters are provided, if available, a moderate rent being charged. Alternatively an allowance in aid of rent may be granted in lieu. Probationers in the Cadet Service and the Police are provided with free furnished quarters.

The currency of Hong Kong is the Hong Kong_dollar, which has no fixed exchange value with sterling. For the purpose of payments in the Colony, sterling salaries are at present converted into Hong Kong dollars at raton fixed from time to time by the Government.
