SIR,

220

No. 202.

MESSRS. SUTTON, OMMANNEY, & RENDALL to COLONIAL OFFICE.

(Received August 3, 1905.)

[Acknowledged by No. 206.] -

3 and 4, Great Winchester Street, London, E.C., August 3, 1905.

Straits Settlements.

Tanjong Pagar Dock Company, Limited.

WITH reference to our interview with you yesterday we enclose copy of two letters which we have this morning received from Messrs. Wheatley, Kirk, Price, and Company, stating that they are prepared to accept an inclusive fee of 3,500 guineas, and explaining the circumstances under which it is impossible for their Mr. Sherley- Price to undertake the valuation. We have written this firm retaining their services on the understanding,-

(a) That two fully qualified assistants proceed to the Colony at the earliest

possible date.

(b) That their Mr. Place should accompany Mr. Trowell on his return to the Colony, or should proceed to the Colony at an earlier date if so desired. (c) That their fee for all services rendered is agreed at 3,500 guineas, which

sum is to include all travelling, hotel, and other expenses.

(d) That the retaining fee is to cover all services which may be reasonably required of the firm in connection with obtaining any information which may be desirable to enable Mr. Place to qualify himself to give evidence. That evidence is to be given as to the value of the machinery both at the Prye Docks and Singapore. That Mr. Place gives such corroborative evidence as may be required of him with reference to the docks, buildings, wharves, tugs, lighters, and other plant, and that should any proceedings in the Arbitration be taken in this country, the firm should assist with their advice as may be required.

We have, &c.,

SUTTON, OMMANNEY, & RENDALL.

Re Singapore Valuation.

DEAR SIRS,

WITH regard to the partner who will undertake this matter, as we explained fully to you at our interview yesterday, it happens that our Mr. Sherley-Price is unable to act, owing chiefly to the fact that he is appointed by deed between two parties, to arbitrate in October. His other engagements could have been undertaken by other partners. Mr. Place, although at the present time engaged valuing engineering concerns of greater extent than Singapore, is doing so with other mem- bers of our firm, and could at this juncture take up your matter and give his whole altention thereto.

Mr. Place's experience is of an exceptional character extending over many years. He has personally valued over two million sterling during the past two years in marine, general engineering, shipbuilding works, and plant. He is fully capable of doing ample justice to your clients.

Messrs. Sutton, Ommanney, & Rendall,

We are, &c.,

3 and 4, Great Winchester Street, E.C.

WHEATLEY, KIRK, PRICE, & CH.

P.S.-It may interest you to know that we have valued most of the firms who supplied the plant to Singapore.

Re Singapore Valuation.

DEAR SIRS,

AFTER our interview with your Mr. Ommanney yesterday, we went to the Colonial Office and saw Mr. Trowell, who obligingly showed us plans, inventories,

&c.

The items dealt with by him are purely of a mechanical nature, i.e., plant, machinery, craft, and stock. There are in addition, as you are aware, other items of considerable importance such as docks, buildings, sea walls, and jetties, on which we shall be prepared to give evidence as to values, in collaboration with Messrs. Coode, Son, and Matthews.

It is perfectly clear from the documents shown to us by Mr. Trowell, emanating from the Dock Company themselves, that they have prepared their claim in a most thorough manner, with the evident intention of substantiating their figures from every possible point of view. So that if beaten in one line of argument as to values, they have several others to fall back upon. Hence, whoever is engaged to make the valuation must be prepared with evidence and facts, as well as weight of experience in such matters, to successfully meet their arguments.

We are prepared to undertake the matter, which is quite within our ordinary routine, for the reduced inclusive fee mentioned verbally by us yesterday, viz., three thousand five hundred guineas, which covers all expenses of principals and staff together with any necessary attendance in London,

Owing to the shortness of time, it is essential that we receive prompt instruc- tions (if possible by next post) if you desire to engage us.

Messrs. Sutton, Ommanney, & Rendall,

REFERRING to your letter of the 27th ultimo,* our junior partner is proceeding to the Colony viâ Marseilles on Thursday next, the 10th instant, and we should be obliged if you would give directions for payment of 1,000 guineas being made to us in the course of next week on account of the remuneration referred to in your letter. The balance, we propose, should be paid on the return of our junior partner to England. Travelling and other incidental expenses we are disbursing from funds we have already received from the Crown Agents on account of the expenses of this arbitration.

We have, &c., SUTTON, OMMANNEY, AND RENDALL.
