4. The Company also desire a rectification of their boundary in respect of land held by them to the eastward of the wharves, where, owing to mistakes or inaccuracies in connection with past surveys, a small triangular gap appears between the lands held by them on two separate titles.

5. They ask that the areas referred to above" shall be of similar titles and the same right as the leases now held by the Company, to which they will adjoin, paying only a purely nominal quit rent.'

6. The Executive Council, to whom the question has been referred, are of opinion that the request is a reasonable one, and advise that a special Ordinance be introduced with a view to give effect to the wishes of the Company in this respect.

7. Of course the Company are prepared to give a quid pro quo, and the terms which the Company would give are so advantageous to this Government that I have no hesitation in recommending the proposal for your approval.

8. In connection with the extension to the docks of the Singapore-Kranji Railway the Government has to acquire from the Tanjong Pagar Dock Company some 24 acres of land through which the line will pass. The valuation, a very moderate one, of this land is upwards of $300,000, and this land the Company are willing to hand over to Government for the purpose in question, subject to Govern- ment paying compensation for buildings taken over or removed, and the cost of any reclamation of swamp land or hill cutting already effected by the Company.

9. The Company propose, further, to give Government representation on the local Board of Direction to the extent of two seats, a matter that would, I believe, prove of great advantage to trade, having regard to the fact that the Company have in effect a monopoly of the wharfage accommodation, and what practically amounts to a monopoly of the warehouse accommodation and coaling arrangements of the port. By having a voice in the deliberations of the Board of Direction the Govern- ment would be able, without undue interference with the transactions of the Company, to facilitate trade by exerting a good influence on the dealings of the Company with the public and a moderating influence in the matter of charges. The position of the Company is so strong that I do not think any apprehension need be felt on the score of responsibility assumed by Government, but even if that were so, the operations of the Company are so extensive and far-reaching that should anything occur now or in the immediate future to interfere with the successful carrying out of these operations the Government would of necessity have to step into the breach.

10. As the early commencement of the improvement contemplated is desired by all parties, I would ask you to be so good as to inform me by telegraph if you approve of the measures which I submit for

your consideration.

Government House, Singapore, March 5, 1904. REFERRING to my despatch, No. 495, of the 18th November last, and your telegram of the 29th December* generally approving the proposals, I have the honour, in accordance with the instructions contained in your telegram, to forward herewith copies of a draft Ordinance to empower the Tanjong Pagar Dock Company, Limited, to improve the alignment of certain wharves at Singapore and to enable the Governor to appoint additional Directors for the said Company for approval.

A BILL intituled "An Ordinance to empower the Tanjong Pagar Dock Company, Limited, to improve the alignment of certain wharves at Singapore and to enable the Governor to appoint certain additional Directors for the said Company."

Whereas the Tanjong Pagar Dock Company, Limited (hereinafter referred to as "the Company ") was established pursuant to "The Companies Ordinance 1889 under a Memorandum of Association, dated the 1st August, 1899: And whereas by the said Memorandum of Association one of the objects of the Company is expressed to be to construct establish maintain execute carry out and equip work develop administer manage and control purchase lease or otherwise acquire in the Straits Settlements and the Malay Peninsula or elsewhere (among other things) wharves jetties and other conveniences suitable for carrying all or any of the business as there- inbefore enumerated:

And whereas the Company have constructed and established and do now maintain a line of wharves jetties and other conveniences extending from Blanga Bay on the West to a dock called Victoria Dock on the East along the seashore of the District known as Tanjong Pagar: And whereas it is expedient for the convenience of the commerce of the Colony that the said Company should have power to improve the said wharves by executing works to correct the alignment thereof and to construct the same in a durable manner upon a line shown upon the plan hereinafter referred to and thereon marked "Regular line": And whereas it is expedient that statutory powers should be given to the Company to execute such works and also that for the further extension of the said wharves a certain piece of land hereinafter described should be held by the said Company as part of certain lands of the Company adjoining thereto: And whereas a plan of the said intended works showing the proposed Regular line of the wharves affected by this Ordinance as well as the present line thereof and also a line showing the limit of deviation hereinafter referred to on the seaward side of the said proposed Regular line has been deposited with the Clerk to the Legislative Council and the same is hereinafter referred to as the "Deposited Plan": And whereas it is expedient that the Governor should have power from time to time to appoint two persons to be Directors of the said Company:

It is hereby enacted by the Governor of the Straits Settlements with the advice

and consent of the Legislative Council thereof as follows:---

1. This Ordinance may be cited as "The Tanjong Pagar Wharves Improvement short title. Ordinance 1904."

The Company may bring their said wharves into a regular alignment on the Power to line marked "Regular line on the deposited plan by inclosing and filling up such align portions of the bed and foreshore of the sea as lie within the said Regular line and by cording to excavating and enlarging the bed and foreshore of the sea where the present line of deposited wharves falls outside the said Regular line.
