I am to suggest, for Mr. Secretary Lyttelton's consideration, that a telegram should be despatched to the Governor of Hong Kong, enquiring whether he can con- firm the above report of Lieutenant Tyrtoff's condition, and instructing him, should the account prove to be correct, to release that officer on parole. In that event Lord Lansdowne would propose merely to inform the Japanese Government of the measure taken and of the reason.

Commissioners of the Admiralty to transmit herewith, for the information of the Marquess of Lansdowne, a copy of a letter, dated 15th August (No. 854) from the Commander-in-Chief on the China Station, and its enclosures, reporting the circum- stances under which the Commander of the "Burni" applied for British protection, and also as to the disposal of the crew.
2. With regard to paragraph 4 of the Commander-in-Chief's letter relative to the treatment of the armis surrendered, my Lords propose, with Lord Lansdowne's concurrence, to inform Sir Gerard Noel that they should be retained until the con- clusion of the war; and it is suggested for consideration whether these arms should not be sent to Hong Kong for custody by the Colonial Authorities.
3. The list giving the names of the crew of the "Burni" being in original, I am to request that it may be returned when done with.

Commander-in-Chief, China Station, August 15, 1904. IN confirmation of my telegram, No. 122, of the 12th instant, I have the honour to report, for the information of the Lords Commissioners of the Admiralty, that on the 12th instant, at 5 p.m., Lieutenant and Commander Tirkov, of the Russian torpedo boat destroyer "Burni," arrived at Weihaiwei, having marched with the other officers and men under his command from the neighbourhood of the Shantung Promontory, and surrendered himself and crew to me. He reported that whilst in a fog, and running away from some Japanese destroyers, his vessel had been wrecked by running ashore at 3 a.m. on the previous day (11th August). I informed Lieutenant and Commander Tirkov that if he gave himself up to me he would be interned until the end of the war. He replied that he understood that would be the effect of his action, and that he still wished to place himself under the protection of the British Government.
2. The officers and crew, of whom I enclose a nominal list, were then sent on hoard the "Humber," which was about to proceed to Hong Kong, and on receipt of their Lordships' telegram approving my suggestion as to their disposal, the " Humber" was despatched to Hong Kong, and the Commodore was directed by telegraph to arrange for the internment of the officers and crew, pending further directions from the Admiralty, and to communicate with the Colonial Government on the subject.
3. On the 13th instant I had the wreck examined. It is lying in a small bay about 10 miles beyond the eastern extremity of British territory surrounding this harbour. The condition of the vessel is as described in Enclosure No. 2.
4. The crew brought their rifles, pistols and bayonets with them; these arms were placed on board the "Vengeance," and I submit that they may be thrown over- board in deep water.

WITH reference to the telegrams,* as per margin, on the subject of 4 officers and 61 men of the Russian torpedo boat destroyer "Burni who arrived in this Colony on H.M.S. "Humber" on the 22nd ultimo, I have the honour to transmit, for the signification of His Majesty's pleasure, an Ordinance to regulate the internment of Japanese forces, which was passed through all

its stages at a meeting of the Legislative Council held on the 15th instant.
2. I enclose also a copy of the usual report by the Attorney-General and copies of the regulations made by me in Executive Council immediately after assenting to the Ordinance.
3. I take this opportunity to transmit, for your information, a copy of a memo- randum of arrangements for the charge of the Russian officers and men from the torpedo boat destroyer " Burni," which, after consultation with Major-General Villiers Hatton, I issued on the 5th instant to Colonel L. F. Brown, now temporarily in com- mand of the troops in South China. Effect is being given to these arrangements, which have since been slightly modified by provision being made for a guard of British in- fantry over the encampment, and by only insisting on one officer being always present in the encampment or in one of the neighbouring messes.
4. The construction of the matshed buildings has taken somewhat longer than was originally anticipated, and it has been necessary to postpone the transfer to the shore from the 15th, the date mentioned in my telegram of the 5th instant, to the 26th or 27th.
5. I have inspected the camp which is situated in the south-west corner of King's Park and is shown on enclosed plan,† and I consider that it provides satisfactorily for the health, comfort, and security of the interned officers and men.
