No. 3 of 1975

'IVIL COMMISSIONERS FOR THE SEYCHELLES Islands to provide further Mɛans to check the LARCENIES of Cocos Nurs in the SEYCHELLES ISLANDS.

WHEREAS it is expedient to enact lurther measures to check the repeated larcenies of Cocoa nuts in the Seychelles Islands;

Therefore be it enacted, and it is enacted :

1. No cocoa nuts whether green or dry shall be removed from any place in the Seychelles Islands to another without being accompanied by a permit.

II. Such permit shall be signed and dated by the person from whose possession the the cocon nuts are removed, shall specify the number of cocon nuts removed, the place from which, and the place to which they are removed, and also the name of the person or persons by whom they are removed.

III. Any person not being able to write may obtain the aforesaid permit from any officer authorised to issue the same by the Chief Civil Commissioner.

IV. Any person found in any place whatever, except land or premises, owned or occupied by him, in possession of green or dry cocoa nuts shall be bound on the applica- tion of any member of the police force to exhibit the permit aforesaid accompanying the Cocoa nuts found in his possession.

V. Any person found as aforesaid in possession of green or dry cocoa nuts refusing or failing to exhibt the permit accompanying the said cocoa nuts shall be forthwith arrested and prosecuted before the district judge by the member of the police force to whom he had refused or failed to exhibit the aforesaid permit. The cocoa buts found in his possession shall further be seized.

VI. Any person prosecuted as aforesaid explaining to the satisfaction of the district judge how he came in possession of the cocoa nuts found in his possession shall be liable, for having refused to exhibit his permit, or for having neglected to have one, to a fine not exceeding 5. sterling. The cocoa nuts seized shall in such case be restored to him.

VII. Any person prosecuted as aforesaid failing to explain to the satisfaction of the distric judge how he came in possession of the cocoa nuts found in his possession shall be held guilty of having stolen the said cocoa nuts and shall be sentenced in terms of Art. 310 of Ordinance No. 6 of 1838. The cocoa nuts seized shall in such case be forfeited.

VIII. Any person aiding and abetting in the removal of green or dry cocoa nuts without a permit as aforesaid shall be liable to the same penalties as the person found in possession of cocoa nuts as aforesaid without a permit.

IX. Any person buying or receiving green or dry cocoa nuts from another person who has not a permit as aforesaid accompanying such cocoa nuts shall be liable to the same penalties as a person found in pcasession as aforesaid of cocoa nuts without a permit.

X. This Regulation shall be read and construed as past of Regulation No. 6 of 1874. XI. This Regulation shall come into force on a day to be fixed by proclamation by the Chief Civil Commissioner.

No. 6 of 1874.

A REGULATION of the BOARD OF CIVIL COMMISSIONERS for the Seychelles Islands to check the LARCENIES of Cocoa Nuts in the SEYCHELLES Islands.

1. Every person licensed to carry on any trade whatever in the Seychelles Islands, buying cocoa nuts or receiving cocoa nuts in payment for his goods or merchandises, shall be bound to keep a special register, in the form of the schedule annexed to this Regula- tion, the leaves of which shall be numbered and initialled by the Collector of Dues and Taxes.

II. Every such person shail be bound to enter in writing in such register the number of cocoa nuts he has bought or received in payment, together with the names and domiciles of the parties from whom he has bought or received in payment the said

cocoa nuts.

III. Such entries shall be made in such register the very day the cocoa nuts have been hought or received in payment.

IV. Every person mentioned in Clause I. of this Regulation shall be bound at the request of any officer or constable of police to produce such register to such officer or constable of police to be examined by him.

V. Any person refusing or neglecting to comply with any of the provisions of this Regulation, or making a false entry, or causing or allowing a false entry to be made, in any such Register, shall for every such offence be liable to a penalty not exceeding twenty pounds, to be recovered before the District Judge, on prosecution by any officer or constable of police.

VI. This Regulation shall come into force from and after the date to be fixed by the Chief Civil Commissioner by public notice.
