There would, further, be the crown pieces, the waling pieces, the struts, the cross bracing, deck beams, planking, &c., necessary to complete the structure.

17. The first portion of the work executed was the causeway. Governor Hennessy has by mistake called it, a "solid abutment.' In technical language the word solid is, I believe, applied to solid masonry, and the causeway being composed of loose coral, is more properly described as a "rubble causeway."

18. The causeway completed, the three first tiers of piles, without however the side or slanting piles (see sketch), were driven at their proper distances, in accordance with the plan, the third tier reaching a distance of 31 feet from the causeway. These three tiers were fixed with their crown pieces, and deck beams.

A fourth tier was then driven, not in the proper position for the fourth tier, but in the position assigned to the seventh tier. This tier was also left without its supporting or slanting piles.

19. The causeway, and these four tiers constituted the extent of the "permanent' work exccuted.

20. Between the third tier and the fourth tier thus driven, the temporary staying was left. Loose planks were placed along the top, and thus a temporary communication was established between the causeway and the fourth, or, as it might more properly be called, the seventh tier of piles.

The convicts carried the coal from the sheds, across the planks, the coaling being thus effected, direct from the shore, and without the necessity of lighterage; and this convenience, as Governor Hennessy has justly observed, has proved of much advantage to the Company.

21. But at the same time, though a useful, this has only been a temporary expedient; and that the wharf was far from being completed in that permanent form which can alone entitle it to be considered complete, may be judged from the fact, that of fifteen tiers to be driven with a total of 103 piles, four tiers only had been driven with a total of twenty-four piles.

Moreover, with the exception of the crown pieces, and deck beams, with which the three first tiers had been axed, there remained to be done the whole of the woodwork (described in paragraph 16) which is necessary to connect, fasten, and strengthen the piling, and which are only less important, in the construction of a wharf, than the piling itself.

22. To take another mode of illustration :-out of an estimated total of 10,586 cubic feet of timber work, for 731 cubic feet rubble was substituted, and the quantity of timber permanently constructed amounted to 1,123 cubic feet, leaving an untouched quantity of 8,732 cubic feet.

28. The continuation of the work will be conducted according to the design shown in Inclosure No. 2. There will be an alteration in the form of the wharf from an L shape to an inverted T shape.

But the dimensions will be generally the same, as instead of one wing of 60 feet in in length, there will be two wings, each of 30 feet in length. There will be no necessity for the small corner tier of three piles, but to strengthen the T head of the wharf it is proposed to add two tiers of six piles each.

24. Under the amended design, the number of tiers will be sixteen, with a total of 112 piles.

Deducting the four tiers, with their total of twenty-four piles, finished in 1871, there remain therefore twelve tiers with a total of eighty-eight piles to construct, together with all the accessory timber work to which I have alluded (pars. 18 and 21) as forming an extensive and essential part of the structure.

25. As the more considerable part of the work remains to be done, so also is it the more difficult portion, because the greater the depth of water the more laborious becomes the work and the greater the necessity for professional skill and supervision.

26. I hope I have succeeded in placing before your Lordship the nature and extent of the work that has been executed, and the nature and extent of what remains to be executed.

But the two designs of the wharf which I have inclosed will best serve to illustrate its actual condition.

Agreement.

THIS Agreement, made this fifteenth day of June, in the year of Our Lord one thousand eight hundred and seventy-two, between Archibald Gray, Esquire, Manager for the Oriental Coal Company, Limited, on the one part, and John Raw Howard, Esquire, Surveyor-General and Superintendent of Convicts for the Government of Labuan, on the other part, witnesseth as follows:-

1st. The said John Raw Howard, having, at the request of the said Manager for the Oriental Coal Company, and with the sanction of his Excellency the Governor, designed and prepared a plan for the further construction and completion of a wharf in Victoria Harbour, on the site of land now held in the said harbour by the Oriental Coal Company, Limited, which wharf was commenced in the month of September 1870, but discontinued in the month of March 1871; and the said plan, so designed and prepared as aforesaid, for its further construction and completion, having been amended and altered in accord ance with the wishes of the said Archibald Gray, has been finally approved and accepted by him on the part of the Oriental Coal Company, Limited, and having been submitted to his Excellency the Governor, has received his sanction.

2nd. The said John Raw Howard, on the part of the Government of Labuan, and with the sanction of his Excellency the Governor, does hereby agree to construct and complete a wharf in Victoria Harbour for the said Archibald Gray, on the part of the Oriental Coal Company, Limited, to be called the Oriental Wharf, according to, and in conformity with the plan above referred to, which is also annexed to this Agreement, and is signed by the said Archibald Gray, upon the following conditions:-

Srd. The said Archibald Gray agrees to furnish and deliver on the ground held by the Oriental Coal Company, in the town of Victoria, all timber, planks, screwed bolts and nuts, plates, nails, ironwork, machinery, and other materials necessary for the construction and completion of the said wharf, and he further agrees that the whole cost of the said timber, planks, screwed bolts and nuts, plates, nails, ironwork, machinery, and other materials, necessary for the construction and completion of the said wharf, and of the delivery thereof, as beforementioned, shall be at the charge of the Oriental Coal Company, Limited.

4th. The said John Raw Howard, on the part of the Government of Labuan, agrees to furnish all superintendence, labour, and other skilled labour, necessary for the construction and completion of the said wharf.

5th. In order, however, to prevent any misunderstanding or questions upon the due and proper execution of the work from hereafter arising, the said Archibald Gray, with the consent of the said John Raw Howard, agrees to employ and pay one European carpenter, who shall assist as a foreman in the construction and completion of the wharf, and it shall be competent for the said foreman, in the execution of his duties as foreman, to bring to the notice of the manager of the Company any departure from the design here agreed upon, or any defect in the execution thereof, as it may appear to him desirable on behalf of the interests of the Coal Company, but the said foreman shall, in the execution of his duties, and in all other respects, be under the orders of the said John Raw Howard, or other superintendent approved of by him or by the Government of Labuan,

6th. The said John Raw Howard, on the part of the Government of Labuan, agrees to construct the said wharf within six calendar months from the date of the seventeenth day of June, one thousand eight hundred and seventy-two, provided always that no delay takes place in the supply of timber, planks, screwed bolts and nuts, plates, nails, ironwork, machinery, and other materials necessary for the construction and completion of the above wharf, as before agreed upon, and any detention arising from the above cause, as well as any detention arising from the employment of the labourers engaged in this work, in loading and unloading coals, for, and on behalf of the Oriental Coal Company, Limited, shall be added day for day to the specified time.

7th. The said Archibald Gray, hereby agrees to pay to the said John Raw Howard, and the said John Raw Howard, on the part of the Government of Labuan, hereby agrees to receive the sum of two thousand one hundred dollars, in consideration of the superintendence, skilled workmanship, and other labour, furnished in the construction and completion of the wharf, as afore agreed; provided always, that in case it shall be shown that the wharf cannot be completed for the sum named with fair and equitable remunera- tion for such superintendence, skilled workmanship, and other labour afforded, as agreed upon, the said Archibald Gray hereby agrees to pay a further sum not exceeding three hundred dollars upon the completion of the work.
