It is clear from Nanking telegram at (185) that nothing short of jurisdiction within the Walled City of Kowloon will satisfy the Chinese. In these circumstances, 'there is no hope of arriving at a solution which will be acceptable to both parties, and I think that we must now seek the views of the Governor of Hong Kong on the next steps to be taken.
4/3.48 1.3.48.
I have prepared a draft telegram for this purpose, setting out the three alternatives which have occurred to us in the Department and also raising the question whether we should indicate to the Chinese that if they wished to refer this question to the International Court at The Hague, we should be agreeable provided that pending such reference, they took all possible steps to prevent the Kowloon issue and any administrative measures that may have to be taken within the area from being the subject of agitation, artificially inspired or otherwise, in China.
I accordingly submit a draft telegram, together with a draft letter to Mr. (Scarlett at the Foreign Office, sending him the draft telegram for his comments. I have had a word with him over the telephone on this, and I think that he agrees that we should seek the Governor's views at this stage, and that we must consider the question of bringing in the International Court of Justice.
