Sir,
I have the honour to refer to my secret (No.2)
despatch of 7th October, 1946, and subsequent correspondence
regarding the application by General Chang Fa-Kwei for the
surrender of Mr. Shum Wai-yau under the terms of the Chinese
Collaborators (Surrender) Ordinance, 1946, and to confirm
my telegram No.12 of 2nd January, 1947, in which I reported
to you that I had decided not to make an order for Mr.Shum'₤
surrender.

In paragraph 3 of my secret despatch of 22nd
October, 1946, I stated that although I had signed a
warrant for the arrest of Mr. Shum the Police had so far
failed to locate him and that it was possible that he had
left the Colony. The question of what action should be
taken in the matter of the application for Mr. Shum's
surrender was exhaustively discussed at a meeting of
Executive Council on 27th November, 1946, when it was
agreed that it was most desirable that before a decision
was taken and communicated to the Chinese Authorities he
should present himself for enquiry and answer the charges
brought against him by General Chang. Steps were taken to
communicate with Mr. Shum and persuade him to appear for
the purpose of an enquiry, with the result that he gave
himself up to the Police and consented to give answers to
