An Ordinance to amend the Criminal Procedure Ordinance.

(13th January, 1978)

Enacted by the Governor of Hong Kong, with the advice and consent

of the Legislative Council thereof.

1. This Ordinance may be cited as the Criminal Procedure (Amend- Son t6, ment) Ordinance 1978.

1 The principal Ordinance is amended by adding after section 73 Adddon of the following new section--

73A. (1) Where after trial in the court a person is (Cap. 221) acquitted, the court may order the payment oul of the public revenue of the costs of the defence, including the costs of any proceedings before a magistrale,

(2) The costs payable to any person under this section shall be such sums as appear to the court reasonably sufficient to compensate that person for any expensea properly incurred by him in or about the defence.

(3) The amount of costs ordered to be pald under this section shall, except where the amount is Exed by the court, be ascertained by the Registrar.

(4) In this section, “court" means the High Court and the District Cour”.
