and the Commissioner shall determine the fares and charges which may be taken by the Company for the services granted under this section.

4B. (1) The Company shall keep, to the satisfaction of the Commissioner, records in respect of the following masters-

(a) the number and capacity of the vessels in use on

each ferry run on cach day;

(5) the number of journeys operated and nautical miles

travelled by each vessel each day;

(c) the number of passengers carried on each ferry

run each day;

(d) the daily receipts in respect of each ferry run.

(2) The Company shall furnish to the|Commissiouer, at such times and in such forma as he may require, copies of the records kept by the Company in accordance with subsection (1).".

4. The principal Ordinance is amended by adding after section 7 the following new sections-

7A. (1) The Governor may give to the Commissioner such directions as he thinks fit with respect to the exercise or performance of his powers, functions and dulies under this Ordinance, either generally or in any particular caso.

(2) The Commissioner shall, in the exercise or per- formance of his powers, functions and duties under this Ordinance, comply with any direction given by the Governor under subsection (1)

78. The Company may, if aggrieved by any decision of the Commissioner under this Ordinance, appeal against such decision to the Governor ia Council, whose decision on such appeal shall be foal.".

5. The Schedule to the principal Ordinance is amended-

(a) in the proviso to paragraph 2(1) by deleting "Governor in

Council" and substituting the following-

"Commissioner after consultation with the Director of Marine and the Director of Public Works":

(b) in paragraph 4(1) by deleting "The fares and charges" and

substituting the following-

“Subject to section 4A, the farea and charges";

(c) in paragraph 6 by deleting "Governor in Council" and sub-

stituting the following-

"Commissioner";

(d) by deleting paragraph 12 and substituting the following--

“Use of

12. (1) Except as may be permitted by the Commis sioner after consullation with the Director of Marine and the Director of Public Works, the Company shall not use the piers for any purpose other than the requirements of the ferry service."

(2) Where a fee is charged by the Company for the use of a pier the fee may be determined by the Governor.

(3) The Company shall, if so required by the Govern- ment pay to the Government fifty per cerir of any fee charged by it under sub-paragraph (2)",

The principal Ordinance is amended by deleting "Commissioner Amendment of for Transport wherever it occurs and substituting in each place the reference to following-

"Commissioner".
