ot the tenancy of such land, and a night of re-entry thereon under the Crown Rights (Re-entry and Vesting Rentedies) Ordinance shall be deemed to have accrued to the Crown.

(2) Where a right of re-entry is deemed under sub- section (1) to have accrued to the Crown and in exercise of such right the Crown has re-entered upon the land, any person who has taken an assignment or underlease, or bui entered into an agreement to take an assignment or under lease, of an undivided share of or in the land together with, The right to exclusive possession, use, occupation or enjoy- ment of any portion of any building to be erected thereon shall, in addition to any other claim be may have, be entitled to recover from the person to whom it was paid soy money or other property which passed, whether by way of consider alion or otherwise, under or by virtue of such assignmeat underlease or agreement.

(3) Subsection (126) shall not apply to an assignment or underlease of, or an agreement to assign or underlet, an undivided share of or in land where the consideration or part of the consideration therefor the erection of the. building to be erected on the land pursuant to an order. made under section 4.*.

Railway (Land Resumption

Enacted by the Governor of Hong Kong, with the advice and consent

of the Legislative Council thereof.

1. This Ordinance may be cited as the Mass Transit Railway (Land Short Utke. Resumption and Related Provisions) (Amendment) Ordinance 1975.

Z. Section 12 of the principal Ordinance is amcoded—–

IQ

(a) by deleting subsection (1) and substituting the following-

*} The Director, any person acting under his authority, may enter any land or building situate wholly or partly within the railway arca or wholly or partly within 70 metres thereof in order to carry out any inspection or survey which is reasonably necessary for the purposes of the railway, including an inspection or survey to ascertain the condition of such land or building prior to the con- struction of the railway, and may also enter any such land or building and carry out all reasonably necessary work of a preventive or remedial nature."; and

(6) in subsection (4) by inserting after "to repair" the following-

"or detect".,
