An Ordinance to amend the Summary Offences Ordinances

Enacted by the Governor of Hong Kong, with the advice and consent

of the Legistative Council thereof.

1.

This Ordinance may be cited as the Summary Offences (Amcod- Shan Ule, ment) (No. 2) Ordinance 1975.

Section 22 of the principal Ordinance is amended-

(a) by re-numbering it as subsection (1);

(b) in subsection (1), by deleting "public servant" wherever it occurs

and substituting the following-

"public officer"; and

(e) by adding the following new subsection-

“(2) In any proceedings for an offence under subsection (1) consisting of falsely pretending to be a public officer, it shall be presumed, until the contrary is proved, that the defendant was not a public officer at the material time.”.
