(b) "occupier" in relation to-
(1) any such thing as is mentioned in paragraph (2), if it has no occupier, means the owner thereof; and
(ii) a road vehicle, means the person in charge of the vehicle and not the occupier of the land on which the vehicle stands; (c) "mixture containing oil" means any mixture of oil with water or with any other substance; (d) "oil" means oil of any description and includes spirit produced from oil of any description and also includes coal tar.
71D. (1) Any person who casts or deposits into the waters of Hong Kong any dead body, ballast, rubbish or other substance without the written permis- sion of the Director shall be guilty of an offence and shall be liable on conviction to a fine of twenty thousand dollars and to imprisonment for six months.
(2) Without prejudice to anything contained in subsection (1), where any dead body, ballast, rubbish or other substance is cast or deposited from any vessel into the waters of Hong Kong the owner, master. agent or charterer of the vessel shall be guilty of an offence and shall be liable on conviction to a fine of twenty thousand dollars and to imprisonment for six months.".
Section 96 of the principal Ordinance is amended in sub- section (1) by deleting the definition of “launch" and substituting the following
**"launch" means any mechanically propelled vessel of Euro- pean type not exceeding three bundred tons which is designed or used for-
(a) the conveyance of persons or things;
(b) towing or pushing; or
(c) any other purpose,
and does not carry passengers beyond the waters of the Colony.".
