included in any of the categories specified in Part III of the Second Schedule, the magistrate, upon application made by or on behalf of the Attorney General—

(a) shall make an order transferring the charge or complaint in respect of the indictable offence to the District Court; and

(6) may, if the person is also accused of any offence triable summarily only, make an order transfer- ring the charge or complaint in respect of the summary offence to the District Court.”.

4. The Ordinances specified in the first column of the Schedule are amended to the extent and in the manner set out ia the second column of the Schedule.

Section 89 is amended in subsection (1)–

(a) by deleting the full stop at the end of para- graph (c), and substitating the following-

or": and

(5) by inserting, after paragraph (c), the following

new paragraph-

"(d) the offence is transferred to the District Court in accordance with Part IV of

the Magistrales Ordinance.".

Section 30 is amended--

(a) in subsection (1), by deleting "for a similar

offence"; and
