43. The Director may exempt any ship of unusual design from the requirements of any of these regulations, to the extent that he is satisfied that accommodation or facilities equal to or superior in standard to those required by these regulations, are available for the use of passengers of any class or grade.

44. The Merchant Shipping (Instructions to Surveyors) (Passenger Accommodation) Regulations and the Merchant Ship- ping (Passenger Space) Regulations are revoked.

Explanatory Note,

These regulations consolidate the Director of Marine's requirements In respect of the provision of minimum pässenger spaces in passenger ships registered in Hong Kong. They provide for the accommodation require- ments of both berthed and unberibed passengers, generally, and also the particular requirements in respect of ships plying within the river trade area and the eastern trade area. Consequential upon the making of thesa regulations is the revocation of the existing provisions in the Merchant Shipping (Instructions to Surveyors) (Passenger Accommodation) Regula- tions and the Merchant Shipping (Passenger Space) Regulations.
