shall be guilty of an offence and shall be liable on conviction to a fine of one thousand dollars and to imprisonment for six months.".

4. Regulation 17 of the principal regulations is revoked and replaced by the following-

17. (1) The Commissioner may refuse to re- gister any motor vehicle—

(2) if it appears to him to be necessary of

expedient so to do in the interests of

( public safety; or

(ii) the regulation of vehicular traffle in the Colony:

(b) if the design, construction, adaptation or condition of the vehicle or any equipment thereof does not comply with the Road Traffic (Construction and Use) Regulations or any other enactment having regard to the class or division of the class of motor vehicle within which application has been made to register the vehicle:

(c) which is not roadworthy:

(d) which does not accord with the particulars contained in the form of application for the registration thereof; or

(e) the owner of which fails to comply with a notice served upon him under paragraph (1) of regulation 18A.

(2) The Commissioner shall refuse to register a motor vehicle if the total number of motor vehicles registered within the class in respect of which applica- tion has been made to register the motor vehicle is cqual to or exceeds the total number of motor vehicles that may be registered within that class having regard to any direction given by the Commissioner under regulation 18B.

(3) The Commissioner may cancel the registra. tion of any motor vehicle-

(a) which in the opinion of the Commissioner is

not roadworthy:

(b) which is not constructed, adapted, or main- tained in accordance with the Road Traffic (Construction and Use) Regulations or any other enactment, having regard to the class

or the division of the class of motor vehicle within which it is registered:

(c) which does not accord with the particulars

thereof entered in the register; or

(d) the registered owner of which has been con- victed of an offence under paragraph (4) of regulation 18A relating to the non-production of the vehicle for examination, inspection, weighing and testing.".

3. The principal regulations are amended by adding after regulation 17 the following new regulations---

"Commis- sioner may refuse to register public: vehicles.

Commis- sioner may cancel regis- Iration of public vehicles.

17A. (1) Without prejudice to regulation 17 and to any other enactment, on an application for registra- tion of a motor vehicle as

(a) a public omnibus;

(b) a public light bus;

(e) a public car; or

(d) a taxi,

the Commissioner may refuse........

(i) to register the motor vehicle; or

(ii) to register the motor vehicle until such coD- ditions precedent to the registration thereof as he may consider appropriate have been complied with.

(2) Without prejudice to paragraph (1) and to regulation 17. the Commissioner may refuse to register a motor vehicle as a public light bus if the owner of the vehicle is not an eligible person.

(3) In this regulation-

"eligible person” means a person who is designated by the Commissioner under regulation 17C as being eligible to be the owner of a public light bus. 178. The Commissioner may cancel the registra- tion of a public omnibus, a public light bus, a public car or a taxi if-

(a) the owner or, where the owner is a partner- ship, one of the partners or, where the owner is a company registered under the Companies Ordinance, a responsible officer of the com- pany, has been convicted-

(i) of any offence in connexion with the use of a motor vehicle as a public omnibus.
