Explanatory Note.

Clerk of Councils.

(This Note is not part of the regulations, but is intended to indicate their general purport).

These regulations prescribe the requirement to be complied with in mation to apparatus belonging to certain classea of apparatus (which are specified in regulation 2), for the purpose of ensuring that such apparatus do not cause undue electrical or radiated interference with the working of apparatus for talecommunication.

2. Regulation 3 applies to apparatus which, after the expiry of six months for the date of publication of those regulations in the Gazerfa, is, in the course of business, to be sold or offered or advertised for sale (except for export), or ket on hire or offered or advertised for letting on hire, or installed, by or on behalf of the manufacturer, assembler or importer. In respect of any such apparatus, the manufacturer, assembler or importer, and, where he operates drough an agent in the Colóny, the agent, must ensure that the apparatus com- plies with the requirement of regulation 7; otherwise, he will be guilty of an offence.

3. Regulation 4 applies to the use, within the Colony, of any apparatus to which these regulations apply, and imposes on the user the obligation to cwure that the apparatus complies with the requirement of regulation 7. In the case of the ignition apparatus of an internal combustion engine, non- compliance with that requirement after the expiry of twelve months from the publication of these regulations in the Gazette, will constitute an offence. In other cases, non-compliance will not by itself constitute an offence but will be grounds upon which a notice may be served under regulation $ prohibiting further use of the apparatus.

4. Regulation $ lays down the circumstances and manner in which a notice may be served by the Telecommunications Authority prohibiting the further use of any apparatus, and in limited cases enables the Authority to seal the apparatus and remove a part of it so as to ensure that it is not used, The Authority has the power subsequently to revoke or vary any such notice. Any person who, knowing that a notice is in force in respect of an apparatus, use the apparatus in contravention of the notice commiss an offence unless

it is made to appear to the court that an application had been made to have the notice revoked and that the Authority, without reasonable cause, had failed i peglected to revoke it within a reasonable time.

3. Regulation & enables warrants to be obtained, where necessary, to enter and search premises, vessels, aircraft or vehicles and to test apparatus found on the search to determine whether or not such apparatus complies with these regulations.

6. Regulation 7, and the Schedule to which it refers, prescribes the requirement, in terms of the maximum permitted electrical supply line terminal toke voltage and the maximum permitted field-strength of radiated electro- rugnetic energy.

7. Regulation & constitutes the Telecommunications Authority as the sole Authority by which measurements are to be made and provides that he shall determine the measuring apparatus to be used and other matters relating to testing apparatus.
