MERCHANT SHIPPING (FEES) REGULATIONS 1965.
In exercise of the powers conferred by section 111 of the Merchant Shipping Ordinance 1953, and all other powers enabling him in that behalf, the Governor in Council has made the following regulations-
1. These regulations may be cited as the Merchant Shipping (Fees) Regulations 1965, and shall come into operation on the day appointed for the commencement of the Merchant Shipping (Amend ment) Ordinance 1965.
2. In these regulations, unless the context otherwise requires— "office hours" means the hours between 9 a.m. and 5 p.m., and 9 am and noon on Saturdays, excluding general holidays within the mean- ing of the Holidays Ordinance;
“surveyor" means a Government surveyor;
"tons" means gross tons.
3. (1) There shall be paid, for the purpose or service relating to merchant shipping mentioned in the second column of the First Schedule, the fees specified in the third column of that Schedule.
(2) Except where otherwise specified in the First Schedule or by necessary implication, the fees prescribed for the issue of any certificate shall be in respect of a certificate valid for a period of twelve months.
4. Where the issue of any certificate or clearance is dependent upon the carrying out of any survey or inspection within the Colony during office hours any fee prescribed by these regulations shall include the services of a surveyor together with any travelling or other expenses involved.
5. Where the issue of any certificate or clearance is dependent upon any survey or inspection to be undertaken outside the Colony by a surveyor sent from the Colony for that purpose, there shall be payable in addition to the fee specified in the First Schedule-
(a) the sum of three hundred and fifty dollars in respect of each period of twenty-four hours or part thereof during which the surveyor is absent from the Colony on account of such survey or inspection; and
(5) the travelling and subsistence expenses of the surveyor in such
reasonable sums as the Director shall determine.

Except in the case of a service rendered by the Mercantile Fees For Marine Office, where the issue of any certificate or clearance is dependent services upon any survey or inspection or where any other service is required to one hours. be undertaken in the Colony, but outside office hours, there shall be payable, in addition to the appropriate fee specified in the First Schedule. First if any, a fee based upon the following scale-
On week days---
(a) between the hours of
8 a.m. and 9 a.m.

(b) between the hours of
6 a.m. and 8 a.m.
Or
6 p.m. and 8 p.m.
(c) before 6 a.m.
or
after 8 p.m.
On Saturdays (after noon), Sundays or public holidays
$40.00 per hour or
part thereof;
$70.00 per hour or
part thereof;
$140.00 per hour or
part thereof;
$200.00 per hour or
part thereof: Provided that if three days notice of the requirement for any survey, or inspection or other service has been given to the Director but notwithstanding such notice the Director has caused the survey, or inspection or other service to be undertaken outside office hours, no such additional fee shall be payable.

7. (1) Where for any service, other than a service specified in the Fees for First Schedule, any officer of the Marine Department is required to visit miscellaneous
services. any vessel, the fee payable for each such visit shall be one hundred and fifty dollars in respect of each hour or part thereof after the first hour Schedule. during which such visit continues.

(2) For the purpose of determining the amount of any fee payable onder this regulation, time shall be calculated inclusive of travelling time to and from the vessel visited:
Provided that in any case in which an officer includes a series of visits to different vessels in one journey, time in respect of each vessel so visited shall be calculated inclusive of travelling time to such vessel only from the shore or the vessel previously visited, as the case may be, except in the case of the last such vessel visited when time shall be calculated inclusive also of travelling time returning therefrom to the shore.
