10. Any person who-

(a) contravenes any of the provisions of by-law 5, 6, 7 or 8 or of

paragraph (2) of by-law 4; or

(b) fails to comply with any direction given to him under the

provisions of by-law 9,

shall be guilty of an offence and shall be liable on summary conviction to a fine of two hundred and fifty dollars,

11. Without prejudice to the provisions of any other enactmen relating to the prosecution of criminal offences and without prejudice to the powers of the Attorney General in relation to the prosecution of such offences, prosecutions for an offence under any of the provisions of these by-laws may be brought in the came of the Council.

12. The provisions of these by-laws, other than the provisions of by-law 9, shall not apply to any act done by the attendant of any public convenience, or by any of his assistants, which is necessary for or incidental to the proper execution of the duties of such attendant or assistant in or about the public convenience.
