It is hereby declared that the provisions of these by-laws replace the provisions of section 50 of the repealed Public Health (Sanitation) Ordinance, 1935.

Any person who contravenes the provisions of paragraph (3) of by-law 4 shall be guilty of an offence and shall be liable on summary conviction to a fine of one thousand dollars and to imprisonment for one month and shall be liable in addition to a fine of twenty dollars for each day during which it is proved to the satisfaction of the court the the offence bas continued.
Without prejudice to the provisions of any other enactment ceedings for relating to the prosecution of criminal offences and without prejudio to the powers of the Attorney General in relation to the prosecution of such offences, prosecutions for an offence under any of the provisions of these by-laws may be brought in the name of the Council.

These by-laws replace section 50 of the repealed Public Health (Sanitatics) Ordinance, 1935. The provisions of subsections (1) and (2) of that sedim (which provided for the issue of permits to live in basements or to occupy, we or let basements otherwise than as garages or for storage purposes) are not reproduced. It is considered that sufficical control can be maintained by mean of closure orders.
