Amendment

3.

of section 9.

(a)

Section 9 of the principal Ordinance is amended by-

the deletion of subsection (1) and the substitution therefor of the following-

"(D) No person shall collect, sell or have in his possession or be a party to the collection or sale, of any pearl oyster:

Provided that nothing in this subsection shall apply

(a) any oyster of the genus Pteria which measures sixty-five millimeters for more when measured through a plane drawn at right angles to the hinge.

(b) an oyster of the genus Pinctada where a person is in possession of a licence granted under sec. tion 6;

(c) the collection or sale of pearl oysters of any size which have been cultivated under a licence granted under section 6."; and

(6) the addition after subsection (2) of the following new sub-

section—

"(3) It shall be a defence to any proceedings for an offence against subsection (2) to prove that the pearl oysters in relation to which those proceedings are brought were not found within the waters of the Colony.”.

Be it enacted by the Governor of Hong Kong, with the advice andİ consent of the Legislative Council thereof, as follows

1. This Ordinance may be cited as the Societies (Amendment) Short title. Ordinance. 1959.

2. The Societies Ordinance is amended by the addition after Addition section 24 of the following new section-
