(b) give such and the like effect to every ground of defence or counterclaim equitable or legal (subject to the provisions of section 18),

as ought to be granted or given in the like case by the Supreme Court and in as full and ample a manner.

(3) In the application of subsection (2) the rules of equity shall prevail in all matters in which there was formerly or is any conflict or Variance between the rule of equity and the rules of the common law.”.

An Ordinance to make provision touching the jurisdiction of the Supreme Court and the District Court respectively in relation to proceedings under section 7 of the Land Transactions (Enemy Occupation) Ordinance, Chapter 256.

[10th July, 1959.]

Bn it enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof, as follows-

1. This Ordinance may be cited as the Land Transactions (Enemy Short ride. Occupation) (Jurisdiction) Ordinance, 1959.

2. (1) It is hereby declared that the Supreme Court has power Jurisdiction to transfer to the District Court proceedings under subsections (1) and of the

Supreme (2) of section 7 of the Land Transactions (Enemy Occupation) court and Ordinance; and it is further declared for the purposes of paragraph 3 the District of the First Schedule to the District Court Ordinance, 1953, that all section. 7 of proceedings transferred by the Supreme Court under the aforesaid power Chapter 256. shall be within the civil jurisdiction of the District Court.
