duties specified in the Stamp Ordinance and the Schedule thereto subject to the modifications shown in the second column of the Schedule to the said regulations;
(c) the aforesaid exemption and modifications were never intended to extend to any instrument affecting land in the New Territories to which Part II of the New Territories Ordinance does not apply;
(d) the Collector of Stamp Revenue has since collected from time to time stamp duties on jastruments affecting land in the New Territories to which Part 1 of the New Territories Ordinance does not apply at the rates specified in the Stamp Ordinance, without applying su exemption and modifications;

(e) the Stamp (N.T.) (Exemption and
and Modification (Amendment) Regulations, 1958, make provision exclude all instruments affecting land in the Ne Territories to which Part II of the New Territor Ordinance does not apply from the aforesaid exemptię and modifications;
( it is expedient to validate the collection of stamp duties on such instruments since the coming into operation ul the Stamp (N.T.) (Exemption and Modification) Reguir tions, 1952.
NOW, THEREFORE, BE IT ENACTED by the Governor of Hoig Kong, with the advice and consent of the Legislative Coun thereof, as follows-
1. This Ordinance may be cited as the Stamp Duby Collection (Validation) Ordinance, 1958.
2. All stamp duties collected by the Collector of Start Revenue since the coming into operation of the Stamp (N.1) (Exemption and Modification) Regulations, 1953, on any instr ment affecting land in the New Territories to which Part II of th New Territories Ordinance does not apply shall be deemed to bas been lawfully collected in all cases where the same would har been lawfully collected if the Stamp (N.T.) (Exemption and Mod fication) (Amendment) Regulations, 1958, had been in operation at the date of the collection.
