CRIMINAL PROCEDURE ORDINANCE. (Chapter 221).

COUNSEL (Fees) (Amendment) Order, 1957.

In exercise of the power conferred by section 9(a) of the Criminal Procedure Ordinance, 1, Chief Justice, hereby make the following Order-

1. This Order may be cited as the Counsel (Fees) (Amend- Citation, ment) Order, 1957.

Paragraph a of the Counsel (Fees) Order, 1952, is Amend-

ment of

paragraph

(a) by the substitution of a semicolon for the full stop at the 2 (G.N.A.

end of sub-paragraph (b);

(b) by the addition after sub-paragraph (b) of the following

new sub-paragraph-

"(c) in any case assigned to counsel which involves the representation of more than one accused by the same counsel there may be paid such addi- tional fee or fees as the Chief Justice may think fit.".

Explanatory Note.

(This Note is not part of the Order, but is intended to indicate its general purport).

Section B of the Criminal Procedure Ordinance authorizes the Chief Justice to make rules and orders (inter alia) for regulating the fees and costs in connexion with the assigning of solicitors and counsel. The Counsel (Fees) Order, 1952, was made by virtue of this authority but it did not provide for any increase of fees where more than one accused was represented at the same time. The purpose of the present order is to give the Chief Justice a discretion to increase fees in such circumstances.
