Explanatory Nate.

(This Note is not part of the regulations but de intended to indicate their general purport).

These regulations re-enact in a different form the majority of the provisions of Part III of the Quarantine and Prevention of Disease Ordinance, Cap. 141, which Part is repealed by the Quarantine and Prevention of Disease (Amendment) Ordinance, 1955.

2. The former section 106 which dealt with limitation of liability is to be re-enacted in Part I of the Ordinance as section 15C; while regulation 24 which prohibits persona obstructing health officers, repro- duces for these regulations a like provision contained in section 9 of the Ordinance. The right of the Director of Medical and Health Services to award compensation where clothing has been destroyed under the provisions of regulation 83 is preserved in a new section 18B which is to be added to the Ordinance.

3. There are some changes in the manner of exercising certain powers. The right of entry and search of premises was formerly exercisable only on a magistrate's order where admission had been refused (section 75). In such circumstances health officers are now empowered to break into premises where necessary, in the presence of a police officer: but this power is given only to health officera authorized for this purpose by the Director of Medical and Health Services (regulation 8). Similarly the power of health officers to require buildings and wells to be cleansed, and in some cases closed, (sections 99, 101 and 103) is now to be exercised only with the approval of the Director of Medical and Health Services. (regulations 19 and 20).
