1BA.

(2) In this regulation-

"owner" includes any person holding premises direct from the Crown, whether under lease, licence or otherwise, and also any person for the time being receiving the rent of any premises, solely or as joint tenant or tenant in common with others, or receiving the rent of any premises whether on his own behalf or that of any other person; and, where such owner as above defined cannot be found or ascertained or is absent from the Colony or is under disability, the agent of such owner; and for the purposes of this regulation every mortgagee in possession shall be deemed an owner."

5. The principal regulations are amended by the Insertion after regulation 18 of the following new regulation--

*'Sale of water from the waterworks.

18A. Any person who sells, offers or exposes for sale any water from the waterworks obtained from an inside service, except for the purpose of supplying water to shipping, shall be liable to a fine of five hundred dollars."

3. Regulation 17 of the principal regulations prohibits the use of waterworks water for flushing "water closets, ate, without the consent of the water authority, but tenants are sometimes obliged to usa waterworka water for this purpose owing to the failure of the landlord to maintain well or nullah aupplies In good order. Since the tenants usually have neither the means nor the right to reinstate independent supplies they should not be held responsible for what is in fact the fault of their landlords. Regulation 4 seeka to make the owner of the premises liable for a contravention by a tenant of regulations 17 of the principal regulations unless an independent supply was available and in good order.

Explanatory Note.

(This Note is not part of the regulations, but is intended to indicate their general purport).

When the insufficiency of the available supply of water necessitates the restriction or auspension of the supply to consumers notice of such restriction or suspension must be given in newspapers approved by the water authority. Regulation 2 permite such notice to be given by letter to the consumers affected thereby providing an alternative method which would be preferable in the ease of restriction or suspension affecting only a limited number of consumers.

2. It has been observed that racketeers frequently interfere with people obtaining water from public standpipes and it is not always possible for such persons to be prosecuted. Another undesirable practice is the sale of water by domestic consumera to persona outside the premises particularly by tenante residing on the ground floor; the heavy draw-off results in the interruption of water supply to consumers on upper doora, Regulations 3 and 5 provide that both these practices shall be offences.
