THE SUPPLIES AND SERVICES (TRANSITIONAL POWERS) (COLONIES, ETC.) ORDER IN COUNCIL, 1946.

In exercise of the powers conferred upon him by section 3 of the Supplies and Services (Transitional Powers) Act, 1945, as extended and applied to the Colony by the Supplies and Services (Transitional Powers) (Colonies, etc.) Order in Council, 1946, the Governor has made the following Order :—

ORDER.

1. This Order may be cited as the Defence Regulations citation. (Ameulment) Order, 1949.

2. Paragraph (1) of Defence Regulation 52 as modified by Rescission

and replace the Defence Regulations (Continuation and Modification) (No. 1}

ment of Order, 1948, is hereby rescinded and replaced by the following *-- Defence

Regulation

"(1) A competent authority if it appears to that authority 52- to be necessary or expedient for any of the purposes specified in section 1 of the Supplies and Services (Transitional Powers) Act, 1945, may take or authorize in writing the taking of possession of any land and may give such directions as appear to be necessary for the taking and maintaining possession of such land and for the eviction therefrom of any person who is, enters or reinatus thereon without the consent of the competent authority.'

Explanatory Note.

The modification is intended to clarify that requisitioning is an executive act solely within the discretion of the competent authority.
