(5) It shall be a defence to a prosecution for an offence against sub-section (4) that the occupier was not aware, and could not with reasonable diligence have become aware, of the existence in the dwelling-house or premises of the radiocommunication equipment in question.
(6) Any person who is guilty of an offence against this section shall be liable on summary conviction to a fine of $9,000 or to imprisonment for any term not exceeding twelve months, and shall upon conviction on indictment be liable to a fine of $10,000 or to imprisonment for any term not exceeding three years,

Subsection 5 of Section 31 of the Telecommunica- Amendment tion Ordinance, 1936 is amended by the insertion of the words No. 18 of "or the Court" between the words "magistrate" and "to" appearing therein.
