(2) In any case tried by the Supreme Court under this Section the deposi tions of the witnesses before the Summary Military Court, any docu- mentary exhibits thereto, any material statement or observation made and any evidence given by the accused person in the course of the proceed- ings before the Summary Military Court may, if recorded by or produced before the Summary Military Court, be used and referred to at the trial in like manner and to the like extent as if they had been duly recorded by or produced before a Magistrate under Part III of the Magistrates Ordinance, 1932, as read with Section 50 of the Evidence Ordinance, 1889. (3) Unless the Chief Justice otherwise directs the trial shall take place at the first Criminal Sessions of the Supreme Court held after the enactment of this Ordinance.
