THE KING'S MOST EXCELLENT MAJESTY
IN COUNCIL,
WHEREAS by the Hong Kong and Shanghai Banking Corporation (Tem- porary Transfer) Order in Council, 1943, the Head Office of the Hong Kong and Shanghai Banking Corporation (in this Order called "the Bank") was transferred from Hong Kong to the United Kingdom, the powers, authorities and discretions veated in and exercisable by the Board of Directors in Hong Kong by the Hong Kong and Shanghai Bank Ordinance and the Regulations in the Schedule thereto were transferred to and made exercisable by the Committee in London constituted under the said Regulations, and the said Ordinance and Regulations were declared to have effect subject to certain amendments, modifica- tions and exceptions:
AND WHEREAS it is now desirable that the Head Office of the Bank should be re-transferred to Hong Kong, and the powers, authorities and discretions previously vested in and exercisable by the Board of Directors should be re- vested in and henceforth be exercised by them;
NOW, THEREFORE, His Majesty, in exercise of all powers enabling Him in that behalf, is pleased by and with the advice of the Privy Council to order, and it is hereby ordered, as follows:-
1. This Order may be cited as the Hong Kong and Shanghai Banking Cor- poration (Re-Transfer) Order in Council, 1998.
2. The Head Office of the Bank shall be transferred to Hong Kong, and the powers, authorities and discretione transferred to the Committee in London by the Hong Kong and Shanghai Banking Corporation (Temporary Transfer) Order in Council, 1943, shall be withdrawn from the Committee in London and re- vested in the Board of Directors in Hong Kong
3. Subject to the provisions of any Ordinance or to the provisions of any Regulations made under the Hong Kong and Shanghai Bank Ordinance, as the case may be, the Hong Kong and Shanghai Bank Ordinance and the Regulations in the Schedule thereto shall have the same effect as they had immediately before the coming into force of the Hong Kong and Shanghai Banking Corporation (Tem- porary Transfer) Order in Council, 1943.
4. The Hong Kong and Shanghai Banking Corporation (Temporary Trans- fer) Order in Council, 1943, is hereby revoked without prejudice to anything lawfully done thereunder.
5. This Order shall be published in the Hong Kong Government Gazette and shall come into operation on a day to be appointed by the Governor by Proclama- tion in the Gazette.
