An Ordinance to amend the Factories and Workshops Ordin-
ance, 1937.

Be it enacted by the Governor of Hong Kong. with the advice and consent of the Legislative Council thereof, as follows:-
1. This Ordinance may be cited as the Factories and short title. Workshops Amendment Ordinance, 1940.
2. Sub-sections (1) and (2) of section 8 of the Factories substitution and Workshops Ordinance, 1987, are repealed and the follow- ing sub-sections are substituted therefor":-

8.-(1) Every person who contravenes or attempts to Offences and contravene or fails to comply with any provision of this penalties. Ordinance or of any by-law made thereunder shall be guilty of an offence against this Ordinance and shall be liable on summary conviction to a fine not exceeding two hundred and fifty dollars: Provided that in the case of a continuing offence the magistrate, if satisfied that the offence has been knowingly and wilfully committed during a period exceeding ten days, may in addition to the said fine impose a further fine not exceeding fifty dollars per day in respect of each day of such excess.
(2) The proprietor of every factory, workshop or indus- trial undertaking in respect of which any offence against this Ordinance has been committed shall be guilty of a like
offence.
