The text of a revised draft bill and regulations embodying the amendments suggested in your savingram under reference is attached for your consideration.

The offices to be excluded from the Commission's purview are set out in Clause 6 (2) and in the First Schedule to the Bill. Your authority in regard to Class I and II appointments and promotions as set out in Colonial Regulations 23 to 26 is safeguarded in clause 15. The position is further explained in paragraph 4 of the Objects and Reasons of the Bill.

Your attention is invited to the omission of the provision originally proposed under Clause 14 (1) (f) to empower the Governor-in- Council to make regulations amending the First Schedule to the bill. Executive Council in advising approval of the text of the draft bill was of the opinion that it was preferable for amendments to the First Schedule to be made by Legislative Council and not by the Governor- in-Council. I have accepted the advice of Executive Council and the power to amend the First Schedule has been omitted from this Clause.

I shall be grateful for your approval by telegram of the introduction into Legislative Council of the Bill and Regulations as now drafted.
