any person in the circumstances set out in sub-sections (a) and (c) of Section (5) and should be required to challenge at least once before firing on any person whom he reasonably believes to be in the act of breaking into a protected place (paragraph (b)). In Singapore where somewhat similar legislation has been approved, the guard is required to challenge three times.

Unless there are very strong reasons to the contrary, I would suggest that directions should be given under Section 4(2) of the Ordinance that guards must challenge three times before discharging firearms in the circumstances: described in subsections (a) and (c) of Section 5 and at least once in the circumstances described in subsection (b) of Section (5).

(1) I understand that, in the case of Singapore, protected places are clearly marked with signboards and warning notices. I assume that similar action has been or will be taken in Hong Kong.

(11) In view of the statement in the Acting

Attorney-General's report that the guards will normally be persons of no great intelligence, I should be grateful for an assurance that in the selection of persons to act as authorised guards under this Ordinance, the greatest care will be taken to ensure that they are capable of exercising properly the exceptional powers which they are granted under it.
