In accordance with the provision of the
Convention for the Extension of Hong Kong, 1898,
Chinese nationals can enter Hong Kong freely.
In an official statement explaining the objects
and reasons for the enactment of the Expulsion of
Undesirables to the Ordinance, 1949, the Hong
Kong Government seems to imply that the free
ingress into Hong Kong was granted to the Chinese
as a matter of tradition. It is however the view
of the Special Commissioner for Foreign Affairs
that the enactment of the Expulsion Ordinance
does not in any way affect the right of the
Convention, 1898, nor can the Ordinance be
construed as to have altered in any way the
treaty obligation assumed by Great Britain
under the said Convention.
