I attach a draft letter to Sir M. Young for Mr. Lloyd's signature as directed.

Mr. Hastings tells me that in his view there is no legal difficulty in making provisional appointments to the Legislative and Executive Councils, but that he does not consider it would be compatible with the relevant Articles of the Royal Instructions to make appointments for limited periods of six to twelve months.

I have added some remarks about M. K. Lo to the letter to Sir M. Young, based on information given to me by Mr. Gimson and Mr. Sloss. They both have recently affirmed that M. K. Lo resisted the pressure put upon him by the Japanese as far as it was possible for him to do so without being imprisoned. (Indeed he was imprisoned for a short period.) In addition, both Mr. Sloss and Mr. Gimson state that M. K. Lo had incurred risks by sending food parcels to both the prisoner of war and civil internment camps during the whole period of the Japanese occupation. Mr. Gimson added that he was of the greatest

assistance to his administration during the first days immediately after the liberation.
