Mr. Lloyd discussed with Sir Mark Young, yesterday afternoon, the question raised in Brigadier MacDougall's letter of the 16th February, which I have temporarily attached to this file, concerning Chinese appointments to the Executive and Legislative Councils.
It was provisionally agreed:-
(a)
that T.N.*Chau and Lee I.U. Cheun should be appointed to the Legislative Council for a period of one year or six months, as suggested by Brigadier MacDougall, provided that his legally possible:

that the recommendation in favour of M.K. Lo should be further considered in the light of his record during the Japanese occupation and the treatment which has been accorded to Sir Robert Kotewall:
(c) that Sir Robert Kotewall should be informed on the Governor's return to Hong Kong that his presence at meetings of the Executive Council would not be welcome.
Mr. Lloyd promised to let Sir Mark Young have a letter enclosing relevant extracts from Brigadier MacDougall's letter of the 16th February, a copy of the telegram from Hong Kong at (51) and giving such information as we have to show how far M.K. Lo was involved with the Japanese compared with, say, Sir Robert Kotewall. The letter should go on to set out the provisional conclusions which were reached at the discussion and Sir Mark Young should be asked to let us know, when he has had an opportunity of considering the matter further, whether he remains in agreement with those provisional conclusions or whether he wishes to modify them in any way.
Would you please let me have a draft for consideration accordingly. If you can clear up the legal point on (a) quickly, I should like that to be done before the draft goes on.
I should also like to deal quickly with the outstanding correspondence on 55217/6B/46 below relating to the arrangements for the hand-over.
