and sentence or may grant a pardon either free or subject to lawful conditions, or may commute the sentence of death to one of imprisonment or fine.

(4) here any person is undergoing a sentence of imprisonment imposed upon him by any such tribunal, the Deputy Chief Civil Affairs Officer, or a Senior Civil Affairs Officer in cases where the sentence of imprisonment does not exceed three years, may quash the conviction and sentence or may grant a pardon either free or subject to lawful conditions, or may remit the whole or any part of the unexpired portion of such sentence.
