(j) the doing of anything necessary to carry out the provision
of this Ordinance within their true intent and meaning, a
generally for the administration, management and control o
the harbours, works and properties under the jurisdiction
of the Port Trust.
(2) By-laws made in accordance with the provisions of this
Ordinance shall be submitted for approval to the Governor in Council,
and when so approved shall be published in the Gazette and when so
published shall have the same force and effect as if enacted herein.
If the violation or non-observance of any by-law is attended
with danger or annoyance to the public or hindrance to the Port Trust
in the lawful use or operation of any of the harbours, works or
property under the administration, management and control of the
Port Trust, it may, by or through its officers or employees,
summarily interfere, using reasonable force, if necessary, to preve.
or stop such violation or to enforce observance, without prejudice i
any penalties incurred in respect thereof.
(1) The Port Trust may levy such dues, rates and tolls as are fixed.
by by-law and may, with the approval of the Governor in Council
commute any dues, rates or tolls so fixed on such terms and
conditions and for such sums of money as the Port Trust deems
expedient.
(2) The Port Trust may not levy new dues, rates or tolls or
increase those in force on the appointed day without submitting the
proposed new dues, rates, and tolls for approval by the Governor in
Council and these new dues, rates and tolls shall become enforceable
after approval by the Governor in Council and publication in the
Gazette.
(3) No officer of Government shall grant a clearance to any vessel
to leave any harbour under the jurisdiction of the Port Trust until
the master thereof produces to such officer of Government a certi-
ficate from an authorised officer of the Port Trust certifying that
the rates, dues or tolls on such vessel have been paid or that none
are payable thereon or that in so far as the Port Trust is concerned
a clearance may be granted.
