shall be dealt with and accounted for by the account ing staff of the Government, but so that the accounts there for shall be kept separate and distinguishable from all other accounts of the Government and shall, on the publication of the accounts of the Government, be published therein under the name of the Trust,

(5) Until such date as may be appointed by order of the Governor in Council any excess of receipts by the Trust over its expenditure shall be paid to the Government at the time of the delivery of the balance sheet and accounts of the Trust and in the event of the expenditure of the Trust exceeding its receipts the deficiency shall be paid by the Government to the Trust.

If at any time it appears to the Governor that any regulation, rule

rule or by-law should be made, amended or rescinded, or any fee, due or charge prescribed, varied or rescinded, such regula tion, rule, by-law or fee, due or charge being within the scope of t Trust as specified in section 6 of this Ordinance, the Governor may make to the Trust such recommendation in that behalf as he may think fit and, if within one month after the maling of such recommendation, the Trust shall not have submitted to the Governor such regulation, rule or by-law as may be necessary to comply with such recomme nda ti on, the Governor in Council may proceed forthwith to make such enactment as he may think necessary in that behalf.

No trustee shall be personally liable in respect of any act done by him in good faith in pursuance of this Ordinance.

22. The Trust shall not be liable for any damage sustained by a ny ve ssel or thing in consequence of any defect in any light, buoy or other aid to navigation or any mooring he user, dock, pier or other thing whatsoever within the area of the Port unless it shall be proved that the Trust was or should have been aware of the defect and could with reasonable diligence have made good
