Paragraph 5 of the Foreign Office letter

of the 12th August, 1935, contains the following

words:-

"It is to be presumed that the export of war material from Hong Kong is only permitted, as in the case of the United Kingdom, to a foreign Government or its accredited representatives: and that, in the case of other arms, due regard is had, both to the size of the consignment and to the standing of the consignee.

"

In paragraph 4 of the United State's Note

dated the 22nd July, 1935, a copy of which was

enclosed in the Foreign Office letter just referred

to, there was made the "assumption that the Governor

ment of Hong Kong will take measures to assure

himself that shipments of arms ostensibly destined

to Macau are actually destined to that port, and in

case he finds that in reality their destination is

China, he will apply to them the same requirements

which he will apply to direct shipments to China."

As regards (1), the position is satisfactory.

As regards (3), I think we must agree with

the Governor, in view of the fact that these exports
