Members of this Chan ber, Messrs. Henry Gardner &
Co. Ltd., have represented that they bought a consignment of tin under a contract which called for a Hong Kong Government certificate of quality showing that the tin assayed at 99%, such Government assay to be final as between buyer and seller. A certificate giving the contents of the tin as 99% was, I understand, issued by the Hong Kong Government Assay Office, but, on re-sampling and re-assaying here by Messrs. Daniel C. Griffith & Co., and Mr. F. Claudet, the tin was found to fall below this percentage. I enclose a copy of a letter from Messrs. Henry Gardner & Co., and copies of other documents in support of their case showing that, through this error, they have sustained a loss amounting to £315-0-4. You will realise that, in view of the terms of the
contract, Messrs. Gardner have no legal claim against the seller, and as it would appear that this loss is solely attributable to an
insufficiently deep hole being drilled by the Hong Kong Assay Office in each slab to obtain fair samples, I am to express the hope that the Hong Kong Government may see its way to compensate Messrs. Henry Gardner & Co. for the loss which they have sustained.
