ATTORNEY GENERAL'S CHAMBERS,
Hong Kong, ..10th November,...1934.
REPORT ON ORDINANCE No.
35......of 193 4.
6
1.
I have examined the accompanying Ordinance. intituled an
Ordinance to amend the Railways Ordinance, 1909, and am
of opinion that it is not one which is contrary to the
Governor's instructions.
2. Under section 35 of the principal Ordinance, as
amended by the Railways Amendment Ordinance, 1927, the
Manager of the Railway had a limited power to dismiss,
suspend and punish for misconduct, and to fine for breach
of a rule, railway servants in receipt of salaries of less
than £100 or $1,000 per annum who were not on the per-
manent staff or serving under written agreements.
3. It has been found desirable, with a view to enforcing
stricter discipline, to increase this salary limit, and
the effect of the amendment of section 35 made by this
Ordinance is to enable the Manager of the Railway to ex-
ercise his disciplinary powers against any employee who
receives less than £200 or $2,000 per annum as salary.
1. In my opinion this is an Ordinance to which His
Excellency the Governor may properly assent in the name of
His Majesty and on His behalf.
Attomey General.
