I am directed by Secretary Sir John Simon to

transmit to you herewith, to be laid before the Secretary

of State for the Colonies, a copy of a despatch with

enclosures in original for eventual return, from the Acting British Consul General at Shanghai relative to

the application of the children of Ali Gulab Mallek

for the registration of their births.

It appears from the enclosure in your letter

No. 82718/31 of the 6th January 1932 that Moslem

marriages are recognised as valid in Hong Kong law.

It would therefore seem that, under the rules which

provisionally

have now been adopted in regard to polygamous marriages,

the marriage of Ali Gulab Mallek according to Moslem rites.

at Shanghai is one which, for the purpose of conferring

British nationality on his children, should be regarded

as valid, whether Ali Gulab Mallek is domiciled in Hong

Kong or in China.

3. In these circumstances, Sir John Simon proposes,

subject to the concurrence of Sir Philip Cunliffe Lister,

to authorise the registration of the births of the children.
