(2) In case it is at any time shown to the satisfaction of the Governor
in Council that the buildings upon the said lot have ceased to be used for the purposes for which the same were erected as provided by conuition (a) or that the average attendance of pupils has fallen so low as to render the continued use of the lot for the purposes of 2 school no longer in the general interests of the Colony it shall be lawful for the Governor to re-enter upon the lot in like manner as for any other breach of the terms of the Crow Lease.
(3) The Grantees shall not sell, assign, mortgage, charge, demise,
underlet, Part with the possession or otherwise dispose of or encumber the lot or any part thereof or any buildings thereon without the consent of the Governor in Council first had & obtained.
(4) The Crown Lease shall contain such covenants as shall be necessary
to give effect to these conditions.
(b) The height, design of the exterior elevations & the disposition of any
building to be erected on the lot to be subject to the special approval of the Director of Public Works.
(c) The Grantees shall develop the lot to the satisfaction of the Director
of Public Works and for this purpose shall provide a general lay out
plan for approval by that officer before any buildings are commenced.
(a) The Grantees shall construct substantial retaining walls
where
necessary, to obviate landslips in the event of theft cutting away the hill to level the site. Should a landslip occur as a result of such cutting or levelling, the Grantees will be held responsible for any damage resulting from or brought about by such landslip.
(e) The drainage of any buildings erected on the lot shall be disposed of
as may be required by the Director of Public Works, and the Grantees must make all arrangements at their own expense and to the satisfaction of the Director of Public Works for the disposal of foul or contaminated water by the construction of septic tanks or otherwise as that officer may require, and the Grantees shall be solely liable for any damage or nuisance caused thereby.
(f) In the event of its becoming necessary or advisable for consideration of
the health to carry out training works in the vicinity of the lot, Grantees shall pay into the Colonial Treasury the total cost of such works,
The work will be carried out by the Director of Public Works. () The Grantees shall make their own arrangements with regard to water
supply.
(h) The Grantees shall pay into the Colonial Treasury, on demand, the cost of removing any Chinese graves at present on the area, if such removal becomes necessary; the work to be done by the Tung Wah Hospital Authorities (j) A right-of-way from Stanley Village to the lot on such lines as may be
The Grantees approved by the Director of Public Works will be given. shall construct a road or path on the piece of ground over and along which such right-of-way shall be given at such time or times and in such manner as the Director of Public Works may direct and shall uphold, maintain and repair such road or path and every thing forming portion of or appertaining to it to the satisfaction of the Director of Public Works, and the Grantees shall be responsible for the whole as if they were absolute owners thereof. Any alteration of the Government road to which the right-of-way is given absorbing a portion of such ground or affecting the gradient thereof shall not give rise to any claim by the Grantees who shall carry out all consequent alterations to such road or path constructed by them.
