With reference to my despatch No.152 of
1st April, 1926, wherein I requested your approval for sale by private treaty to the Hong Kong and China Gas Company of
a site in Kowloon, I have the honour to inform you that after prolonged negotiations the Company has found it
impossible to accept the terms and conditions of sale originally set out in the despatch above quoted, and approved by you in your despatch No.145 of 21st May, 1926.

These conditions were submitted under the
impression that they were then acceptable to the Company,
a mistake of which your despatch No.203 of 7th July, 1926,
shows that you were aware.
3.
I understand that the misapprehension arose
from the fact that the capital necessary to take up and
develop the site originally suggested under the conditions
laid down was not available. It is felt, however, that it
is necessary to make early arrangements for future expansion, and with that view I entirely agree.
4.
The conditions for sale by private treaty of
a marine lot at Ma-tau-kok which I now recommend for your
approval and of which a copy is enclosed, are I consider
