Lai Fin refused to carry out the order of the 6th March and when examined before the Chief Justice on the 13th of April asserted that Homan Chung had only "authority over the ship but no authority to settle the suit. Counsel on both sides then consented to the following order, to which Hai Lin appears to have assented with reluctance, after asking for time to communicate with the Annamese Government.
A question having been raised whether the parties who represented the defendant in this Court were duly authorised by the King of Annam both parties consenting. The Court does order that the Foreign Attachment suspended be revived and that the Dangwee be restored to the custody of the Court upon the Foreign Attachment as if the Order of the sixth March One thousand eight hundred and seventy four had not been made. Let all parties and persons have liberty to proceed by themselves or their Agents to Annam and make such arrangement there as they shall respectively be advised and see to. Let the proceedings be thus suspended and subject to the further order of the Court.
Upon the next day the 14th of April 1874 The plaintiff took out a fresh writ of attachment, and the Danguee was again attached in the hands of her new Commander Lai Tiv, and she so remained until the 23 April 1875, having in the interval undergone the terrific typhoon of the 22nd September last.
