What is a constitution? What do you know
"about the Constitution of Hong Kong?
A constitution is the fundamental law of the state which governs the composition and powers of the various. organs of the government. These organs are the Executive, Legislative and Judin ciary.
The: constitution sets down the
rights and obligations of the people and the duties and powers of the government powersyof as well as
changed. The constitution of the country is above all the ordinary laws.

A written constitution is in the form of a document which has, special "sanctity. It is found in a number of

An unwritten constitution has grown up on the basis of custom rather than written law.
A. constitution which can be altered. or amended without any special machinery A.constitu− is a flexible constitution. tionwhich requires special procedure for its alteration or amendment is a rigid constitution.

This classification of a constitution on the basis of whether they are written or unwritten is illusory because there is no constitution which is entirely unwritten and no constitution entirely written.
The Constitution of Hong Kong consiste of a number of documents. They are

c) the Colonial Regulations
d) the Governor's Commission.

The Letters Fatent are the earlier and more important document. They ate the office of the Governor and define his powers: mainly to make laws, to make grants of land, to appoint judges and other officers of the government, and to grant pardons. The letters Patent also authorizes the creation of the Executive. and Legislative Councils in very vague terms.
The koyal Instructions fill in the gaps left by the Letters Patent. They are mainly concerned with the details
of the composition, powers and procedures of the Executive and Legislative Councils, the method of appointment and dismissal of the members and how ordinances are to be drawn up, etc.
The Colonial Regulations are descri- bed as Directions to governors for genern al guidance: given by the Crown. through. the Secretary of State for the Celonies. These directions are usually followed and observed by the Governor in the execution of ms duties in Hong Kong.

mentioned in the Letters Patent and Royal Instructions.
The Standing Orders of the Legislative Council are guiding principles which govern the procedures of the passing. of. laws.
The Orders-in-Council are orders issued from time to time. having binding force on the government and the people of Hong Kongo.
The Ordinances passed in the Legisla- tive Council and the British Parliament as well as the decisions of the law courts" in Hong Kong are also some of the guiding principles in the administration of HoKo
Finally the Capt。 Elliot's Proclamm ation states that in the administration of H.Ko, the governor has to respect the rights and the opinions of the Chinese here. It affects the Governor of HoK
As we can see from above, the Con- stitution of Hong Kong is not made of a signle document, but a number of documents. They all determine the ways how Hong Kong should be governed.
