for upwards of five years appeals from Consular decisions

in China have lain and been

made to this Supreme

Court

and Criminals have been

sent from Consular

in China to this Colony both for imprisonment and

for trial.

It shocks me that either

we have been

carrying out wrong

in such sections in

the China Order in Council

without a special Ordinance

on the subject, or that

such Ordinance is not

required to carry provisions

of the

"the Japan

Ordinance.

If it be legislation on the subject

it would be unwise to do

so in an incomplete

manner.

And I would suggest that the directions of the Secretary of State for the Colonies

should be obtained as to whether such legislation

should embrace the Order in

Council for China as well as that for Japan.

It appears to me that question depends

on

the Act 6 & 7 Vict: Cap: 94
